Terms and Conditions

1. General scope, type of contracts

The subject of the contract is the use of the photo booth or 360° video booth selected under the contract for the contractually agreed period.

Beyond the contractually agreed service, no specific result and no further service is owed. These Terms and Conditions are deemed agreed upon placing the order; conflicting terms of the customer are not recognized.

A consumer is any natural person who concludes a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur is a natural or legal person or a partnership with legal capacity that, when concluding a legal transaction, acts in the exercise of its trade, business or profession.

2. Basis of services

The use of the photo booth or 360° video booth is suitable for indoor use only; moisture must be avoided so that our devices and electronics do not suffer moisture damage. In exceptional situations the devices may be used outdoors. In any case, the customer is responsible for ensuring that no damage is caused to the devices; otherwise the customer must cover the damage.

For setting up the photo booth we require a floor space of 2.50 x 2.50 m and at least 3 x 3 m of floor space for the 360° video booth.

3. Booking and registration

If the date is available and you transfer the requested deposit, the date is firmly booked and secured for you.

The remaining amount is due before the event or on the day of the event, before we start. If the customer does not pay after being requested to do so, we reserve the right to dissolve the contract and not provide our service.

4. Termination / cancellation

In the event of cancellation by the customer no later than 90 days before the date stated in the contract, the deposit will be refunded. After that, a refund of the deposit is no longer possible.

Termination for good cause is always permitted. We are entitled to cancel a date for important reasons. The customer will be informed of this immediately before the start of the service. In this case, rebooking to an alternative date is offered. If this is not accepted by the customer, the customer will receive a refund of any fee already paid.

Further claims are excluded unless the damage was caused intentionally or through gross negligence.

5. Liability

Within the scope of the rental, we are liable to customers only insofar as damage is based on a grossly negligent or intentional breach of duty. Liability for slight negligence is excluded. This limitation of liability does not apply in the event of injury to the life, body or health of a customer. We are likewise liable for the fault of our vicarious agents in accordance with the above provision.

Photos/videos that are not suitable for minors or that glorify violence are strictly prohibited. The right of personality belongs to the person depicted. Each customer is responsible for obtaining the consent of the person depicted. The customer assumes responsibility for copyright and usage rights.

The customer uses our services entirely at their own risk and assumes responsibility for their actions inside and outside the event as well as in the rooms provided.

In the event of incomplete performance (e.g. a technical malfunction), liability is limited to a maximum of the rental price.

Should it not be possible to print photos due to a technical failure, compensation is limited to the free subsequent delivery of the photos.

Any technical malfunctions must be reported within 48 hours of the rental day. After that, no claims can be asserted.

6. Severability clause

Should individual provisions of this contract be invalid or should this contract contain gaps, the validity of the remaining provisions remains unaffected. In place of the invalid provision, the valid provision that comes closest to the intent and purpose shall be deemed agreed.
